U.S. senators are poised to take up a long-anticipated piece of legislation next week that would create a regulatory structure for cryptocurrency, possibly breaking a legislative impasse that has set crypto firms against American banks. The measure, referred to as the Clarity Act, would, upon becoming law, delineate financial regulators’ authority over the emerging sector, potentially spurring wider use of digital assets.

Senator Tim Scott, who leads the Senate Banking Committee, stated on Friday that the committee would convene an executive session on May 14 at 10:30 a.m. at the Dirksen Senate Office Building in Washington, D.C.

The cryptocurrency industry has been urging passage of this bill, arguing it is critical for the survival of digital assets in the United States and essential for resolving deep-rooted, persistent issues faced by crypto firms. Among other elements, the legislation would specify when crypto tokens are considered securities, commodities, or something else, offering the sector legal certainty.

The bill also contains a clause aimed at addressing a contentious conflict between crypto companies and the banking sector. Under an agreement worked out by Republican Senator Thom Tillis and Democratic Senator Angela Alsobrooks, customer incentives on uninvested holdings of dollar-pegged crypto tokens known as stablecoins would be banned, due to their similarity to bank deposits. Incentives tied to other stablecoin activities, such as processing a payment, would still be allowed.

Banking trade associations have objected to this clause, claiming it grants crypto firms excessive leeway and could draw deposits away from the regulated banking system. Banks have mounted a final push to sway some Republicans on the Senate Banking Committee ahead of the hearing, but whether they can achieve this remains uncertain.

Banking industry lobbyists have been pushing for an amendment to the Clarity Act to close what they call a loophole created by legislation enacted last year that permits intermediaries to offer interest on stablecoins. Banks contend this would cause a withdrawal of deposits from the insured banking system, possibly endangering financial stability. Crypto firms counter that barring third parties, such as crypto exchanges, from paying interest on stablecoins would be anticompetitive.

The industry hopes the Clarity Act will be approved in the coming months before the November midterm elections, when Democrats might take control of the House of Representatives. The House passed its own version of the Clarity Act in July of last year, and the Senate must pass the bill by the end of 2026 to send it to President Donald Trump for his signature.
